1. Acceptance of terms

By creating an account or using any part of the site, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to these Terms and our Privacy Policy. These Terms are updated from time to time. Continued use of the site after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes by email.

2. Service description

Outnumber is an entertainment and information tool. We provide:

• Weighted lottery number generation designed to reduce expected prize-sharing
• Contrarian scoring and analysis tools
• Australian lottery game guides and results history
• Statistical analysis tools (EV Calculator, Jackpot Predictor, etc.)
• Optional account features including saved sets and jackpot alerts (Pro)

Outnumber is not a gambling service. We do not operate a lottery, accept wagers, or sell lottery tickets. We are not licensed as a gambling provider and are not subject to state gaming legislation in that capacity.

Nothing on this site constitutes a guarantee or prediction of lottery outcomes. No strategy or tool provided here improves your probability of winning any lottery. Use this service for entertainment purposes only.

3. Free tier and Pro subscription

Free tier: The core features of Outnumber are available at no cost. Free accounts are subject to limits (for example, 5 saved number sets). We reserve the right to modify free tier limits with reasonable notice.

Pro subscription: Pro unlocks additional features as described on the Pricing page. The Pro subscription is billed monthly at $4.99 AUD (inclusive of GST) via Stripe. By subscribing, you authorise us to charge this amount each billing period until you cancel.

4. Subscription billing and auto-renewal

Pro subscriptions are billed monthly and auto-renew on the same date each month unless cancelled before the renewal date. You will receive a payment receipt by email after each successful charge.

All prices are in Australian dollars (AUD) inclusive of GST. We reserve the right to change the subscription price with at least 30 days written notice to your registered email address. You may cancel before the price change takes effect to avoid the new price.

Payment is processed by Stripe. By subscribing, you agree to Stripe's terms of service. We do not store your payment card details.

5. Cancellation and refunds

You may cancel your Pro subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period. You retain Pro access until then and are not charged again after cancellation.

Refund policy (Australian Consumer Law): For new subscribers only, if you request a refund within 7 days of your initial billing date and have not made substantial use of Pro features, we will provide a pro-rata refund for the unused portion of the billing period. This right applies once per customer. Subsequent subscription periods are non-refundable except where required by the Australian Consumer Law.

To request a refund, email hello@upgraded.au within the 7-day window with your account email address and the reason for your request.

6. Prohibited conduct

You agree not to:

• Use the site if you are under 18 years of age
• Use automated scripts, bots, or scrapers to access or extract data from the site without our express written permission
• Attempt to reverse-engineer, decompile, or copy our proprietary algorithms
• Use the site in a way that violates any applicable Australian law or regulation
• Share your account credentials with third parties or create multiple accounts to circumvent free tier limits
• Post or transmit any content that is defamatory, harassing, or otherwise unlawful

7. Intellectual property

All content on the site including text, design, graphics, software, and algorithms is the intellectual property of Outnumber or its licensors and is protected by Australian copyright law. You may not reproduce, distribute, or create derivative works from our content without prior written permission. Using the site does not grant you any licence to our intellectual property beyond the personal, non-commercial use permitted by these Terms.

8. Limitation of liability

To the maximum extent permitted by Australian law:

• Outnumber is provided "as is" and "as available" without warranty of any kind, express or implied
• We make no representations about the accuracy, completeness, or reliability of lottery data, jackpot figures, or analytical results displayed on the site
• We are not responsible for any loss or damage arising from reliance on information provided by this site
• We are not liable for any gambling losses you incur as a result of using this site

Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded by contract.

9. Affiliate links

Some links on this site to licensed lottery operators are affiliate links. We may earn a commission when you purchase tickets via these links. This does not affect the price you pay. Our tools, scores, and editorial content are not influenced by affiliate relationships. Full disclosure is available on the Affiliate Disclosure page.

10. Responsible gambling

You must be 18 or older to purchase lottery tickets in Australia. This site is for entertainment purposes only. If gambling is causing you harm, free and confidential support is available from Gambling Help Online on 1800 858 858 or via gamblinghelponline.org.au.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
